These terms cover your use of Ballast, a mobile game about stacking cargo with a harbour crane. By installing or playing Ballast you agree to them. If you do not agree, do not play the game. Ballast's handling of data is described separately in the Privacy Policy, which forms part of these terms.
You may play Ballast if you are old enough to form a binding agreement where you live, or if a parent or guardian agrees to these terms on your behalf. Ballast is intended for players aged 13 and over. On first launch you choose whether to allow personalised ads, as described in the Privacy Policy.
We grant you a personal, non exclusive, non transferable licence to install and play Ballast on devices you own or control, for your own entertainment. The game, its code, art, sound and name remain ours. You may not sell, rent, sublicense or redistribute the game or any part of it.
The game detects edited save files and may reset progress that cannot be verified. Anything you paid real money for is restored through your app store rather than from the save, using Restore Purchases in Settings.
Coins, shards, containers, cosmetics, cargo types and upgrades exist only inside Ballast. They are a licence to use a game feature, not property, and they have no monetary value. They cannot be exchanged for money or transferred out of the game, they are not a bank balance, and we do not owe you anything for them.
Because the game is balanced over time, the price, earn rate, effect and availability of any virtual item may change, and items may be added or retired. We may do this to keep the game fair or playable. Where a change materially reduces something you bought with real money, we will make a reasonable effort to compensate you in game.
Virtual items are tied to your local save and, where you have enabled it, to your platform cloud save. If you delete the game and its save without cloud save enabled, unspent items are lost.
Real money purchases in Ballast are processed entirely by your app store, Google Play on Android or the Apple App Store on iOS. We never see your payment details. The store's terms and refund policy govern the transaction, and any refund request goes to the store, not to us. Prices shown in the game come from the store and are in your local currency.
Consumable items such as coin and shard packs are delivered once and are used up in play. Non consumable purchases, such as Remove Ads, can be recovered on a new device with Restore Purchases, because the store holds the record of them.
Ballast is free to play and is paid for by advertising. Banner advertisements appear during play, interstitial advertisements may appear between runs, and rewarded advertisements can be watched by choice in exchange for a bonus. Buying Remove Ads stops banner and interstitial advertising; rewarded advertisements you choose to watch still work, because they are how those bonuses are granted. We do not control the content of third party advertisements, and complaints about a specific advertisement should go to the network named in the Privacy Policy.
Ballast is provided as it is, when it is available. We may update it, change how it works, or stop distributing or supporting it. We will not remove a paid feature you already own while the game remains available. If we shut the game down we will say so in the game or at this address before the servers behind purchases and cloud save stop working.
You can stop at any time by deleting the game. We may suspend or end your access if you break these terms, in particular by tampering with save data or defrauding the rewarded advertising system. Where the breach was not deliberate we will try to warn you first.
Ballast is provided without warranties of any kind, to the extent the law allows. We do not promise that it will be uninterrupted, free of defects, or compatible with every device, and we do not promise that your save will never be lost. Keep cloud save enabled if your progress matters to you. Nothing here limits rights you have under consumer law that cannot be limited by agreement.
To the extent the law allows, we are not liable for indirect or consequential loss, lost progress, lost virtual items, or lost profit arising from your use of Ballast. Where liability cannot be excluded, it is limited to the greater of the amount you paid us for Ballast in the twelve months before the claim, or the minimum the law requires. Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded.
These terms are governed by the laws of Israel, and its courts have non exclusive jurisdiction. If you are a consumer, this does not take away the protection of the law of the country where you live, or your right to bring a claim there.
If these terms change, the new version will be published at this address with a new date, and the game will ask you to accept it again the next time you open it. Continuing to play after that means you accept the new version.
